Welcome to LocalLoco. These Terms of Service ("Terms") govern your access to and use of the LocalLoco platform, including our website, mobile application, and related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms.

1. Definitions

"Platform" refers to LocalLoco's website, mobile application, and all related services.

"User," "you," and "your" refer to individuals who access or use the Platform.

"Merchant" or "Shop" refers to businesses offering deals through the Platform.

"Deal" refers to promotional offers, discounts, or special pricing posted on the Platform.

"Redemption" refers to the act of using a Deal at a participating Merchant.

"We," "us," and "our" refer to LocalLoco and its operators.

2. User Responsibilities

By using the Platform, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Use the Platform in compliance with all applicable laws and regulations
  • Respect the intellectual property rights of LocalLoco and third parties
  • Not engage in any activity that disrupts or interferes with the Platform

3. Platform Usage Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes.

You may NOT:

  • Use the Platform for any commercial purpose without our written permission
  • Copy, modify, or create derivative works of the Platform
  • Use automated systems (bots, scrapers) to access the Platform
  • Reverse engineer or attempt to extract source code
  • Remove or modify any copyright, trademark, or proprietary notices

4. Real-World Activity & Rewards

4.1 Check-Ins & Verified Purchases: LocalLoco operates as a real-world activity engine. You can interact with Merchants via proximity Check-ins or by verifying purchases (e.g., uploading valid receipts) to earn "Loco."

4.2 Trust Scoring & Tiers: Your actions on the Platform are monitored to calculate a "Trust Score" based on behavioral patterns (such as dwell time, GPS proximity, and genuine purchases). Higher Trust Scores elevate you through our Trust Tiers (Bronze, Silver, Gold, Platinum), unlocking better rewards and status.

4.3 Reward Validation: Rewards (Loco) are subject to a validation period and may be delayed or revoked if fraudulent behavior is suspected. You agree not to spoof GPS locations or submit false receipts.

4.4 Merchant Autonomy: Deals and interactions do not require active manual verification from the Merchant in most cases. You must comply with individual Merchant policies.

4.5 Zero-Cost Economy: Loco is earned via physical engagement. We reserve the right to modify, adjust, or expire Loco and Tier statuses without prior notice based on our sole discretion and system algorithms.

5. Verification, Integrity & Location Data

5.1 Location Tracking: To function as an activity engine, LocalLoco requires access to your device's location services. By enabling GPS, you permit us to track proximity to Merchants for check-ins, trust scoring, and deal discovery. You can disable this at any time, but doing so will severely limit functionality.

5.2 Platform Verification Rights: LocalLoco relies heavily on behavioral and location data to maintain our Zero-Effort Merchant philosophy. We reserve the right to verify the authenticity of all user check-ins, dwell times, and purchase events.

5.3 Fake Deals & Fraud: A "fake interaction" includes:

  • GPS spoofing or using emulators to falsify location data
  • Uploading manipulated, reused, or false receipts
  • Attempting to exploit the Trust Score or Loco algorithms
  • Merchants posting fake deals or misleading terms

5.4 Consequences of System Abuse: Any User or Merchant found manipulating the Activity Engine will face immediate consequences:

  • Permanent hardware/account bans
  • Complete forfeiture of Loco, Tiers, and Rewards
  • Reporting to relevant authorities where applicable

5.5 No Liability for Third-Party Deals: While we utilize strict behavioral proof to combat fake engagement, LocalLoco does not guarantee the accuracy of Deals posted by Merchants. See Section 8 (Liability Limitations) for more.

6. Prohibited Activities

You agree NOT to engage in any of the following activities:

  • Posting or sharing false, misleading, or fraudulent content
  • Harassing, threatening, or intimidating other Users or Merchants
  • Attempting to manipulate the lucky draw or redemption systems
  • Creating multiple accounts to circumvent limitations
  • Sharing account credentials with others
  • Uploading fake or manipulated receipts
  • Violating any applicable laws or regulations
  • Infringing on intellectual property rights
  • Transmitting viruses, malware, or other harmful code

7. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, software, and data compilations, is the property of LocalLoco or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You may not use our trademarks, logos, or branding without our prior written consent.

8. Liability Limitations

8.1 Platform "As Is": The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's availability, accuracy, or fitness for a particular purpose.

8.2 Third-Party Merchants: LocalLoco is not responsible for the actions, omissions, products, or services of third-party Merchants. Any disputes regarding Deals, redemptions, or Merchant conduct should be resolved directly with the Merchant.

8.3 Limitation of Damages: To the maximum extent permitted by law, LocalLoco shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform.

8.4 Maximum Liability: Our total liability to you for any claim arising from your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Dispute Resolution

9.1 Informal Resolution: Before initiating formal proceedings, you agree to contact us to attempt informal resolution of any dispute.

9.2 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

9.3 Arbitration: Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law.

10. Termination Rights

10.1 Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your profile settings.

10.2 Termination by Us: We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

10.3 Effect of Termination: Upon termination, your right to access and use the Platform will immediately cease. You will forfeit any pending lucky draw entries, rewards, or benefits.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the modified Terms.
